Senior Personal Injury Attorney

Description
Warner & Fitzmartin, PLLC is a boutique plaintiff’s personal injury firm built for one purpose: to take care of injured people and bring the best possible client outcomes.
We are now looking for a Senior Personal Injury Attorney who can bring mature litigation judgment, disciplined case ownership, and real leadership to a growing plaintiff’s practice. This is not a role for someone who merely wants a title. This is a role for a serious lawyer who can evaluate cases clearly, move matters decisively, prepare files with trial in mind, and help the firm continue building a litigation practice known for excellent outcomes and exceptional client care.
Because this is a senior litigation role, qualified candidates must have personally tried personal injury cases to a jury as first chair. You know how to manage plaintiff’s personal injury cases with urgency, leverage, and judgment. You can spot the difference between delay and strategy. You know when a case should resolve, when it needs to be pushed, when a suit should be filed, and when a client needs clear, honest counsel about risk, value, timing, and next steps.
You are also a leader inside the case file. You can direct staff clearly, mentor less experienced attorneys, collaborate with the Managing Partners, and keep cases moving without creating chaos around you. You do not need to be managed every day to do excellent work. You bring structure, follow-through, and calm command to the litigation process.
We have a simple rule: no ego, no drama, no “that’s not my job.” We all pitch in here; we protect clients, and we protect each other. If you think you are too important to help with a task that keeps a case moving, this will not be a fit. We also believe great lawyers should have great lives outside of work. When someone’s child is sick, the team covers. When deadlines hit, we handle them together. We expect grit and accountability, and we practice grace and teamwork.
SPECIAL BONUS: If your background is insurance defense, you are still welcome here—and you might just LOVE it. In your cover letter, tell us what changed for you and why you now want to advocate for injured people. Tell us what you learned on the defense side that will make you a sharper, more strategic, and more effective plaintiff’s lawyer. For this senior role, we are especially interested in lawyers who understand how carriers, adjusters, defense counsel, experts, and delay tactics actually operate—and who are ready to use that knowledge to build stronger cases, create leverage, protect clients, and drive better outcomes.
This role is primarily remote but requires in-person attendance for court hearings, depositions, mediations, trials, and other case-related events as needed. Candidates must reside within a reasonable driving distance of the relevant courts or be able to travel on short notice.
Responsibilities
YOU WILL BE SUCCESSFUL IN THIS ROLE IF YOU CAN:
- Move personal injury cases with senior-level judgment, urgency, and accountability from pre-suit through litigation, settlement, or trial.
- Evaluate liability, damages, causation, coverage, liens, medical proof, evidentiary gaps, and case value early enough to create a clear plan of action.
- Drive cases toward fee-in, suit-filed, mediation, settlement, or trial with a defined strategy, deadlines, and follow-through.
- Build leverage through disciplined discovery, depositions, motion practice, expert development, and trial-ready preparation.
- Bring first-chair jury trial experience in personal injury and use that experience to shape case strategy, discovery, expert development, damages presentation, settlement leverage, and trial readiness from the outset.
- Prepare and negotiate high-quality settlement demands and case resolutions that reflect strong valuation, persuasive advocacy, and practical command of the file.
- Manage a litigation pipeline without allowing cases to stall, drift, or become dependent on partner rescue.
- Identify risks early, elevate them with proposed solutions, and help the team avoid last-minute emergencies whenever possible.
- Communicate with clients clearly, compassionately, and proactively, especially when the news is difficult or expectations need to be reset.
- Direct paralegals, case managers, and support staff with clarity, respect, and accountability so that every file remains organized, current, and moving.
- Mentor junior attorneys and litigation staff by modeling strong legal judgment, preparation, communication, and professional standards.
- Collaborate closely with the Managing Partners while reducing unnecessary partner re-entry into matters that should be moving under senior attorney ownership.
- Contribute to the firm’s litigation systems, case review structure, templates, workflows, and operating discipline as the practice continues to grow.
KEY RESPONSIBILITIES
- Manage a plaintiff’s personal injury caseload from intake, pre-suit evaluation, and demand strategy through litigation, mediation, settlement, or trial.
- Develop and execute case strategy to advance client goals, maximize recovery, preserve leverage, and maintain trial readiness.
- Analyze liability, damages, causation, insurance coverage, medical treatment, liens, subrogation, and evidentiary issues at the outset and throughout the life of each case.
- Draft, review, and file pleadings, discovery, motions, memoranda, settlement materials, correspondence, and other litigation documents with accuracy, clarity, and strategic purpose.
- Prepare for and handle hearings, case management conferences, depositions, mediations, and other court appearances.
- Take and defend depositions of parties, fact witnesses, treating providers, experts, and corporate representatives as appropriate.
- Prepare clients and witnesses for depositions, mediations, hearings, and trial-related proceedings.
- Oversee the development of settlement demands, mediation statements, damages presentations, and negotiation strategy.
- Negotiate case resolutions with adjusters, defense counsel, and other parties while protecting client interests and firm standards.
- Support trial preparation and trials, including witness preparation, exhibit development, motion practice, case themes, jury instructions, and courtroom strategy.
- Direct and support paralegals, case managers, and legal support staff to ensure tasks, deadlines, documents, notes, medical records, liens, and file status are current and actionable.
- Participate in regular case review meetings and provide concise, accurate updates on case posture, risks, next steps, and anticipated resolution path.
- Mentor associate attorneys and litigation staff by providing practical guidance on case evaluation, client communication, litigation preparation, negotiation, and professional judgment.
- Maintain proactive, high-touch client communication and ensure clients understand case status, risks, options, and expectations throughout the process.
- Use the firm’s case management and document systems consistently to maintain organized files, deadlines, tasks, notes, litigation plans, and documentation.
- Help strengthen the firm’s litigation workflows, templates, case review process, delegation practices, and quality-control systems as the firm scales.
Qualifications
Required
- Juris Doctor from an accredited law school.
- Active membership and good standing with the Florida Bar.
- Demonstrated first-chair jury trial experience in personal injury, including responsibility for courtroom strategy, witness examination, evidentiary presentation, opening and closing, and jury-facing advocacy.
- Minimum of 7 years of litigation experience, with meaningful experience in plaintiff’s personal injury, insurance defense, bodily injury litigation, or a closely related civil litigation practice.
- Demonstrated ability to independently manage personal injury or civil litigation matters from early evaluation through resolution, mediation, trial preparation, or trial.
- Strong case valuation, liability analysis, damages analysis, negotiation, legal writing, and oral advocacy skills.
- Experience taking and defending depositions, handling hearings, preparing clients and witnesses, and moving cases through discovery and mediation.
- Ability to direct staff, delegate clearly, supervise case movement, and maintain organized litigation files.
- Strong professional judgment, emotional maturity, and ability to communicate clearly with clients, opposing counsel, adjusters, medical providers, experts, and internal team members.
- Compassionate, client-centered approach and commitment to excellent client communication.
- Comfortable working in a primarily remote legal environment with strong responsiveness, documentation, task management, and calendar discipline.
- Skilled in Microsoft 365 and modern legal-tech workflows, including PDF editors, case-management systems, document automation tools, e-signature platforms, structured calendaring, workflow templates, and litigation task tracking.
- Ability to attend in-person court appearances, depositions, mediations, trials, and other case events as needed.
Preferred
- Significant plaintiff’s personal injury experience.
- Prior insurance defense experience with a genuine desire to advocate for injured people.
- Trial experience or meaningful trial preparation experience.
- Experience mentoring junior attorneys, paralegals, case managers, or litigation support staff.
- Experience helping a growing law firm improve litigation workflows, case review systems, templates, delegation structures, or file accountability.
Compensation
$110,000 - $200,000/year
