Harper Law Firm, PLLC, a growing plaintiff-side personal injury law firm in San Antonio, Texas, is seeking an experienced, highly motivated, and results-driven Pre-Litigation Attorney to join our legal team.
We are looking for an attorney who has substantial experience handling personal injury claims from intake through settlement or transition into litigation. The ideal candidate understands how to evaluate cases, establish liability, maximize damages, negotiate effectively with insurance carriers, and consistently move cases toward favorable resolutions.
This is not an entry-level position. We are seeking an attorney who can independently manage a substantial pre-litigation docket, make sound strategic decisions, and deliver strong financial results while providing exceptional client service.
At Harper Law Firm, our attorneys are expected to take ownership of their cases, proactively identify opportunities for resolution, and maintain consistent forward movement.
Pre-Litigation Case Management & Strategy
Independently manage a docket of plaintiff personal injury cases from intake through settlement or litigation referral.
Develop and execute case strategies designed to maximize settlement value and achieve timely resolutions.
Evaluate liability, causation, damages, insurance coverage, and overall case value.
Identify potential coverage issues, additional defendants, and opportunities to maximize recovery.
Review medical records, billing, treatment history, and supporting evidence to assess damages.
Identify cases requiring litigation and coordinate timely transitions to the litigation team.
Maintain accurate case valuations, settlement projections, and anticipated resolution timelines.
Demand Preparation & Settlement Negotiations
Oversee the preparation and timely submission of comprehensive, persuasive settlement demands.
Review and approve demand packages for accuracy, completeness, and strategic effectiveness.
Independently negotiate settlements with insurance adjusters, defense attorneys, and insurance carriers.
Develop effective negotiation strategies to maximize client recovery.
Evaluate settlement offers and provide informed recommendations to clients.
Identify and address obstacles that delay settlement negotiations or case resolution.
Ensure cases are consistently progressing toward demand, negotiation, settlement, or litigation.
Client Communication & Team Collaboration
Maintain consistent, professional communication with clients regarding case status, treatment, settlement expectations, and next steps.
Work closely with paralegals, legal assistants, and firm leadership to ensure timely case progression.
Provide clear direction to support staff regarding case priorities, deadlines, and required actions.
Ensure case files are accurate, organized, and properly maintained in Filevine.
Comply with all firm standard operating procedures, reporting requirements, and case-management expectations.
Participate in docket reviews, case strategy meetings, and performance discussions.
Required Qualifications
Active Texas law license in good standing.
Meaningful experience handling plaintiff-side personal injury claims, preferably in a high-volume practice.
Demonstrated success independently managing pre-litigation personal injury cases.
Strong understanding of Texas personal injury law, insurance coverage, liability, and damages.
Proven ability to negotiate favorable settlements with insurance carriers.
Experience evaluating medical records, treatment plans, injuries, and case values.
Excellent negotiation, communication, analytical, and problem-solving skills.
Strong organizational skills and the ability to manage a substantial docket efficiently.
Ability to work independently, prioritize effectively, and consistently meet deadlines.
Preferred Experience
Motor vehicle accidents, commercial vehicle/trucking accidents, premises liability, catastrophic injury, and wrongful death claims.
Experience handling complex liability and high-value personal injury cases.
Experience using Filevine or similar legal case-management software.
Experience supervising or directing paralegal support teams.
